Overton FDA vote pushed past the midterms

The Senate HELP Committee has pushed its vote on Heidi Overton’s nomination for FDA commissioner past the midterm elections, which means the FDA will likely go without a confirmed commissioner into November. The agency has been led in an acting capacity by Kyle Diamantas since Marty Makary resigned in May 2026.

Chairman Bill Cassidy has not committed to supporting Overton, and reporting after her September 24 hearing said it was unclear how undecided Republicans on the committee would vote — a single Republican defection in committee could sink the nomination. Major shifts in agency direction tend to wait for permanent leadership, so drug, food, and vaccine decisions keep moving while the top job stays open.
